LAPTOP RETURNS & WARRANTY

RETURNS | The laptops are purchased through Amazon.com. We can assist in the return process within the first 25 days of purchase for a full refund*. “FULL REFUND” means the total amount possible through debit and credit card processing.
WARRANTY | The laptops are purchased NEW and come with a 1 year manufacturer warranty. We do not provide any warranty our self on the laptop. In the event you need servicing of your device you will be required to contact the manufacturer directly. We can help you find the contact if needed.

SUBSCRIPTION TERMS

MONTH TO MONTH | You are in NO way bound by any contract to submit a payment to us beyond one month of membership. You have the option to be automatically billed or pay one month down. If you choose to manually renew your membership, it will automatically cancel after 30 days. If you would like to reactivate your membership at anytime in the future, simply sign in and submit the one month payment amount to receive full membership access.
MEMBERSHIP CREATION & SOFTWARE TRIAL | The $9.99 fee to create the membership account and software trial is non-refundable.

TRAINING SUPPORT

DESKTOP & LAPTOP | we offer to help build up to 4 free workouts in the first year for your fitness goals. Users can download the workouts via the member section of the website after the request is completed. Workouts can take up to 7 – 14 days to provide, but typically take less than 5 working hours.
TABLET & MOBILE | unsupported. Supported referencing.

RIGHTS OF USE

SINGLE LICENSE | a single family or individual can use the product.
COMMERCIAL LICENSE | Individuals who have signed the liability waiver can use the product under the licensee’s instruction.

UPDATES

You will receive free software and chart updates for life as long as you are a member.

EMAIL

We do not send “junk mail”; typically important software updates or downloads are emailed only.

PRIVACY

We do not share customer information with anyone. In case of a “buy out” we will give you 90 days to review new policy updates.

AFFILIATES

Affiliate commissions start at 10%. Commissions increase as referrals increase. We partner with individuals and facilities in an attempt to make a profit for all parties. Payouts can be arranged via Pay Pal or Check and require a minimum of $50.00 worth of referral commissions.

EQUIPMENT TRIALS
• In certain cases the Athletic Performance System offers equipment & membership trials to trainers and/or gyms interested in the product. The trial period shall last for a specified amount of time. Once the trial is over 2 options shall become available #1 Pay for the equipment and membership moving forward or #2 Request return labels. In the event a return is requested or no intent to use is stated before the trial is over, the trial period shall cease from the moment of notice. The Athletic Performance System shall issue return boxes & labels if requested. The trainer or company agrees to return ship all the equipment sent out in working order within 21 days of receiving the return labels and boxes via USPS. Should any equipment be damaged, the trainer or company agrees to pay the wholesale replacement cost of the item + 40%.

WAIVER OF LIABILITY TERMS

It is understood that you are “Reader”, “User”, and/or “Purchaser”

Terms

The “Reader” acknowledges the Athletic Performance System is not a toy and should not be considered as such. Any use of the equipment other than what is outlined in the training system will void all warranties. Improper use of the products voids all warranties. Damage from improper storage of the products will void all warranties (i.e. storing in direct sunlight).

Software

The “Reader” acknowledges the Athletic Performance System training software is supported on all Windows and Macintosh desktop and laptop devices on or offline. The software is unsupported on all tablets and mobile devices.

Accounts

Accounts are set up in the cloud so user can access their account through an internet connection. ACCOUNT SHARING is prohibited; we retain the right to terminate your membership without notice and without refund.

Liability Release

The “Reader” acknowledges that they are personally responsible for any hardship, injury, or death that may occur as a result from using the Athletic Performance System information or equipment.

Physical Condition

The “Reader” acknowledges they have been cleared by a Medical Doctor to perform exercise including but not limited to; Strength Training, Cardio Vascular Training, Stretching, Self-Massage Techniques, Interval Training, Warm Up Activities, and/or ALL HEALTH & FITNESS activities.

Nutrition

The “Reader” acknowledges the nutritional information in the athletic performance system should not be considered authoritative. The reader acknowledges and agrees to seek a registered dietitian for proper dietary guidelines and intake.

Hydration

The “Reader” acknowledges the hydration information in the athletic performance system should not be considered authoritative. The reader acknowledges seeking medical or professional guidance to properly test their sweat rate and or hydrate their body.

No Duplicate

Individuals, Trainers, and Organizations may not under any conditions use any information in the athletic performance system that is not in the public domain. Replicating or Duplicating any of the training in another brand, product, training session, photo/video shoot, DVD, commercial shoots, for notoriety, profitability, or anything that can be considered health & fitness related is illegal. The “Reader” asserts responsibility if the information is mishandled.

The reader agrees to not disclose any of the information in the Athletic Performance System that cannot otherwise be found in the public domain; and cannot be used without written permission of the Athletic Performance System owner.

Medical Release

The Reader Understands the information in the Athletic Performance System is not meant to replace Doctors Orders, Registered Dieticians, clinical advice, therapy programs, or specific training & nutrition guidelines. The Athletic Performance system acknowledges its freedom of speech and expression of opinion concerning various topics. The Reader agrees to hold Athletic Performance System and its owners, agents, employees, confidant’s, families, person’s, and affiliates harmless on all accounts in the event of any hardship, injury, or death. The information furnished can be used and/or applied at the reader’s discretion.

Age Limitations

The Purchaser of this Athletic Performance System acknowledges they are 18 years or older. The “Purchaser” is considered the Responsible Party; the responsible party accepts, assumes, and asserts all liability and agrees to supervise any minor at all times when using the Athletic Performance System.

Customers are the “The Purchaser”

I, “The Purchaser” of the Athletic Performance System fully understand and agree to all TERMS | CONDITIONS | LIABILITY | PRIVACY in this agreement. I have fully read and fully agreed to everything in this agreement

I hereby affirm that I am in good physical condition and do not suffer from any known disability or condition which would prevent or limit my participation in this exercise program. I have been advised that an examination by a physician should be obtained by anyone prior to commencing a fitness and/or exercise program, or initiating a substantial change in the amount of regular physical activity performed. I hereby agree that I am doing so solely at my own risk. I understand that it is my sole responsibility to participate in exercises that are appropriate for the current status of my health. If I have any questions or concerns about whether or not a particular activity is appropriate to my current health status, I understand it is my responsibility to ask my doctor if this activity is appropriate before I participate in such activity.

I understand that this program is not medically supervised, and exercise activities are led by my own independent guidance and discretion. I agree not to hold Athletic Performance System, its owner’s, agent’s, operator’s, employee’s, confidant’s, person’s, or affiliates responsible for any harm or damages that may occur from using the athletic performance system.

I understand that the Athletic Performance System may, in its sole discretion and at any time, revoke my rights to use the training software at any time a violation of the no duplicate or copyright agreements. The purchaser assumes responsibility for any and all damages that may occur to the athletic performance system as a result.

I understand that any exercise or fitness activity involves a risk of injury, as well as abnormal changes in blood pressure, fainting, and a remote risk of heart attack, stroke, other serious disability or death. I am accepting such risks and volunteering to participate with full understanding of the dangers involved. In consideration of my participation in this program, I , __”The READER, USER, and/or PURCHASER”____, hereby waive and release Athletic Performance System and its successors and assigns, from any and all claims, costs, liability and expense for any hardship, injury, death, loss or damage whether known, anticipated, or unanticipated arising from my voluntary participation and purchase of the athletic performance system.

THESE TERMS CAN BE UPDATED, CHANGED, OR MODIFIED AT ANYTIME, IT IS YOUR RESPONSIBILITY TO STAY UPDATED WITH OUR TERMS.

I ACKNOWLEDGE THAT I HAVE THOROUGHLY READ THIS FORM IN ITS ENTIRETY AND FULLY UNDERSTAND IT. I UNDERSTAND THAT IT CONTAINS A RELEASE OF LIABILITY. BY PURCHASING A PRODUCT and/or SIGNING THIS DOCUMENT, I AM WAIVING CERTAIN RIGHTS I OR MY SUCCESSORS MIGHT HAVE TO BRING A LEGAL ACTION OR ASSERT A CLAIM AGAINST ATHLETIC PERFORMANCE SYSTEM AND IT’S OWNERS AND AFFILIATES.
